The Court of Appeal’s civil decisions this week covered a number of areas including insurance, securities (secondary market misrepresentations), dismissal for delay, family, debtor-creditor, limitation periods, summary judgment and franchising in the class action context.  There were also numerous short civil and criminal law endorsements.

The Court of Appeal released a number of civil decisions this week.

Blaney’s own Jason Mangano was counsel for the successful respondent insurer in Forsythe v Westfall in which the Ontario Court of Appeal held that that the applicable law of the insurance policy for the defendant driver is not relevant in determining 

Good evening.  As usual, there were quite a few summary judgment cases dealt with by the Court of Appeal this week, several dealing with limitation periods, including in the areas of medical malpractice, defamation, slip and falls, and negligence.  There was also an interesting franchise law decision discussing the contract law doctrine of severance of
